Please read these terms and conditions carefully.

Article 1 - Definitions

In these terms and conditions, the following definitions apply:

Customer: the natural person or legal entity that uses the services of 2 Broers 4 Rechterhanden.

Services: performing tiling work, such as tiling floors, walls, kitchens, bathrooms, gardens, and/or terraces.

Agreement: the agreement between 2 Broers 4 Rechterhanden and the customer regarding the provision of services.

Article 3 - Applicability

1. These general terms and conditions apply to all offers, quotations, work, agreements, and deliveries of services or goods by 2 Broers 4 Rechterhanden.

2. Deviations from these terms and conditions are only valid if they have been agreed in writing or electronically.

3. No additional codes of conduct or conditions apply, unless this is communicated in writing in advance.

Article 4 - The Offer

1. Prices and services are determined per quotation.

2. All offers are non-binding, unless otherwise stated in writing.

3. Quotations are valid for 30 days after the quotation date, unless otherwise indicated.

4. If, after the quotation has been issued, the prices of materials or labor costs increase due to circumstances beyond the control of 2 Broers 4 Rechterhanden (such as delivery costs, fuel prices, or VAT changes), this price increase may be passed on to the customer, provided that this is explained in advance.

Article 5 - Formation of the Agreement

1. The agreement is concluded as soon as the customer has approved the quotation from 2 Broers 4 Rechterhanden, either: - in writing or by email, - by returning the signed quotation, or - by giving clear consent via WhatsApp or other electronic communication.

2. By accepting the quotation, the customer also declares that they agree to these general terms and conditions.

3. Amendments or additions to the agreement are only valid if they have been confirmed in writing or digitally by both parties before the start of the work.

Article 6 - Implementation and Planning

1. The execution and start date of the work will be determined in consultation with the customer.

2. If the work is delayed due to weather conditions, delivery problems, or other unforeseen circumstances beyond the control of 2 Broers 4 Rechterhanden, the execution period will be reasonably extended without entitlement to compensation.

3. Additional work (extra work not included in the original quotation) will only be carried out after consultation with the customer. The additional work will be carried out on the basis of a predetermined total price, which will be confirmed in writing or digitally.

Article 7 - Materials

1. Materials are supplied by 2 Broers 4 Rechterhanden, unless otherwise agreed.

2. The customer can choose in advance from the available range or supply their own materials after consultation.

3. If the customer supplies materials themselves, 2 Broers 4 Rechterhanden is not liable for damage, delays, or defects resulting from incorrect or unsuitable materials.

4. Damaged or incorrectly delivered materials by third parties are at the supplier's risk; 2 Broers 4 Rechterhanden will assist in mediating a solution.

5. Longer delivery times may apply to custom-made or special tiles; these will be communicated to the customer in advance.

Article 8 - Prices and payment

1. Prices are determined per quotation, including VAT, unless otherwise stated.

2. Payment must be made within 7 days of the invoice date, unless otherwise agreed in writing.

3. In the event of late payment, the customer will owe statutory interest (8% for business customers, 6% for private individuals), plus reasonable collection costs in accordance with the Collection Costs Act (WIK).

4. For larger projects, it may be agreed that the customer will pay a deposit of 30% upon confirmation of the order, 40% halfway through, and 30% after delivery.

Article 9 - Cancellation and right of withdrawal

1. Cancellation by the customer is only possible after written approval by 2 Broers 4 Rechterhanden.

2. In case of cancellation within 2 weeks prior to the agreed start date, the customer is obliged to pay 50% of the agreed amount.

3. For cancellations within 5 business days prior to commencement, 100% of the total amount will be charged.

4. In case of force majeure (such as illness, death in the family, or unforeseen disasters), cancellations or rescheduling may be made free of charge in consultation.

Article 10 - Compliance and Guarantee

1. 2 Broers 4 Rechterhanden guarantees that the work will be carried out properly and in accordance with the agreements made.

2. The tiling work carried out is covered by a 12-month warranty after completion, unless otherwise stated.

3. The warranty does not apply in the event of: - incorrect use or improper maintenance, - damage caused by third parties, - subsidence or structural problems with the subfloor, - wear and tear due to normal use.

4. Any defects must be reported in writing within 14 days of discovery.

Article 11 - Liability

1. The liability of 2 Broers 4 Rechterhanden is limited to direct damage and amounts to a maximum of the invoice amount for the assignment in question.

2. 2 Broers 4 Rechterhanden is not liable for indirect damage, such as consequential damage, loss of profit, or damage caused by delay.

3. Exclusions from liability apply in cases including: - existing defects in walls, floors, or surfaces; - damage caused by extreme weather conditions or moisture problems; - instructions or materials provided by the customer.

Article 12 - Complaints

1. Complaints about the performance of work must be reported in writing or by email within 14 days of completion to 2broers4rechterhanden@gmail.com.

2. 2 Broers 4 Rechterhanden will respond within 10 working days and, if necessary, make an appointment to assess and resolve the problem.

3. If the parties fail to reach agreement, mediation may be requested through an independent mediator before legal proceedings are initiated.

Article 13 - Disputes

1. All agreements are governed exclusively by Dutch law.

2. Disputes shall in the first instance be submitted to the competent court in Eindhoven.

3. The parties will first attempt to resolve the dispute through mutual consultation or mediation before taking legal action.

By accepting the quotation, the customer automatically agrees to these General Terms and Conditions of 2 Broers 4 Rechterhanden.
